Hotel Terms of Service

These conditions shall apply to all sales transactions between The Highland Soap Co. Limited ("the Company") and any person, firm or company ("the Purchaser") placing an order with The Highland Soap Company for the manufacture and/or supply of any goods ("the Goods"). The Highland Soap Company by accepting any order for Goods from the Purchaser agrees to sell and the Purchaser agrees to purchase such Goods at the price stated on The Highland Soap Company's website or order form and on the sole basis of the terms and conditions of The Highland Soap Company stated herein.

To purchase our products at trade prices you must be approved as a hospitality customer by The Highland Soap Company, based on our company’s policies regarding location and suitability. The company reserves the right to decline any application, as it deems necessary without assigning any reason. By placing an order with The Highland Soap Company the Purchaser agrees to comply with these terms and conditions and understands that any breach of these requirements on behalf of the purchaser may result in permanent exclusion from any future trading with the company.

PRICE: Trade prices for Goods are quoted exclusive of VAT at the current rate. The price does not include the delivery of the order to the Purchaser. This is an additional cost, unless otherwise stated. The Company reserves the right to change prices at any time, and unless otherwise stated to invoice at the Company’s list price ruling at the actual date of dispatch.

MINIMUM ORDER: There is no minimum order value for hotels.

DELIVERY: Carriage cost is charged at £10 + VAT on orders under £300. Carriage is free for orders over £300. As our products are handmade, delivery will normally be within 10-14 working days from receipt of payment.

PAYMENT: We accept payments for trade orders by card, cheque, or bank transfer with orders dispatched on receipt of payment. Credit account holders must: have ordered and paid in full for a total of at least 4 or more pro-forma purchases; have been trading with the company for a period equal to or over 9 months, within which time the customer must have purchased over £2,000.00 (ex vat ) worth of stock; be approved by the company, based on the information and references provided by the purchaser, which must be as accurate as possible. 

Account holders are obliged to pay the balance of their credit in full no more than 30 days after the delivery of any order. Any outstanding invoices must be paid in full before further goods will be sent. If an order exceeds the agreed credit limit, credit account holders must pay any outstanding balance which exceeds this limit before the goods will be dispatched. The company reserves the right to end any credit agreement, as it deems necessary, should any violation of this contract occur.The company reserves the right to end any credit agreement, as it deems necessary, should any violation of this contract occur.

AVAILABILITY: All goods are offered subject to availability. On out-of-stock items, delivery dates are estimates only and time of delivery is not the essence of the contract. The Company will endeavour to deliver goods promptly but accept no liability for delay for any cause. The Purchaser shall not be entitled to refuse to accept late delivery or treat late delivery as a breach of contract. We do not send out small back orders unless specifically requested to do so and carriage paid.

RETENTION OF TITLE: Property in the Goods shall not pass until the full amount has been paid.

FORCE MAJEURE: The Highland Soap Company will exercise every reasonable effort to meet the requested dispatch date. The Highland Soap Company shall not, however, be liable for any loss or damage due to delays or failure to ship resulting from any cause beyond its reasonable control, such as but not limited to compliance with laws or regulations, acts of God, acts or omissions of the Purchaser, acts of civil or military authority, judicial action, defaults of sub-contractors or suppliers, labour disputes, failure or delays in transportation, embargoes, wars or riots.

SHORTAGES OR DAMAGED GOODS: Any shortages on delivery or if the Goods are damaged, the Purchaser should contact The Highland Soap Company within 3 days of receipt of Goods. Damaged Goods must be returned to The Highland Soap Company, Inverlochy Mains, North Road, Fort William, PH33 6TQ suitably packaged. The Company will replace or credit the items concerned.

RETURNS: Undamaged goods returned due to Purchaser error will result in the issue of a credit note. We cannot accept any items showing signs of being used, displayed or in such a condition as to render them not re-sellable. We only refund monies paid arising from our error, or at our discretion. Goods to be returned to The Highland Soap Company, Inverlochy Mains, North Road, Fort William, PH33 6TQ suitably packaged.

PRODUCT VARIATIONS: Please be aware that product colour and texture variations occur occasionally, and naturally as part of the handmade manufacturing process and nature of the raw plant ingredients we use.

INGREDIENTS INFORMATION: Specific product ingredients may be found on our website (www.highlandsoaps.com). Browse our online catalogue and click on the appropriate product for complete information including product descriptions, instructions for use, and ingredients listings in INCI format.

STORAGE INSTRUCTIONS: Our products are suitable for use up to 30 months from the date of manufacture. Where appropriate, period after opening (open jar) symbols are displayed on the packaging with the number of months the product may continue to be used after opening.

UK & EU COSMETICS REGULATIONS: Some of our products may be available in bulk containers for refilling our wrapped and labelled bottles. The Cosmetics Regulations in the EU allow for products to remain unlabelled providing that appropriate legal information is displayed at the point of sale or use. It is each business’ responsibility to display this information at the point of sale or use. The Highland Soap Co. Ltd cannot accept responsibility for any action taken against businesses or individuals if they do not display legal information at the point of sale, or use of cosmetic products. We are happy to offer advice to customers regarding any aspect of the Cosmetics Regulations and your responsibilities, or the display of product information.

ONLINE PRESENCE: No warranty is given by The Highland Soap Company that our website will be constantly online or free of defects and errors at any time. The Highland Soap Company prohibits the re selling of products on eBay, Amazon or any other discount or third-party website without our prior written consent.

PRIVACY POLICY: The Highland Soap Company collects the information provided by the Purchaser at the time of ordering and uses this information lawfully and in accordance with the Data Protection Act 1998. Information is collected by The Highland Soap Company to process the Purchaser's order and also to provide the highest level of customer service possible. JURISDICTION: These terms and conditions shall be governed by and construed in accordance with Scottish Law and the Purchaser hereby agrees to be subject to the jurisdiction of the Scottish Courts.

COPYRIGHT NOTICE: Permission must be agreed for the use of the Company’s images and text, this intellectual property is for the express use of authorised trade customers. Any images provided by the company are only to be used for the express purpose for which they were granted. The Highland Soap Company reserves the right to withdraw the permission for the use of its images at any point, without assigning any reason. The entire content included on our website, but not limited to text, images or code is copyrighted collective work under the United Kingdom and other copyright laws, and is the property of The Highland Soap Co.
